CGV & CGU – CONDITIONS GÉNÉRALES DE VENTE et D'UTILISATION (FR)

 1. Objet

Les présentes Conditions Générales de Vente (CGV) régissent la vente de formations en ligne proposées par Thomas Vincent.

2. Prix

Le prix de la formation est fixé à 500 € TTC.
Le prix est identique pour tous les clients.

3. Paiement

Le paiement s’effectue en ligne par carte bancaire.
La commande est considérée comme validée après confirmation du paiement.

4. Accès à la formation

L’accès à la formation est immédiat après validation du paiement.
Un compte personnel avec identifiants uniques est fourni au client.

Les accès sont strictement personnels, individuels et non transférables.

5. Droit de rétractation et renonciation

5.1 Principe

Conformément à l’article L221-18 du Code de la consommation, le client dispose en principe d’un délai de 14 jours pour exercer son droit de rétractation.

5.2 Exception applicable aux contenus numériques

Conformément à l’article L221-28 du Code de la consommation, le droit de rétractation ne peut être exercé pour les contenus numériques fournis sur un support immatériel dont l’exécution a commencé avant la fin du délai de rétractation.

5.3 Renonciation expresse

En validant sa commande, le client :

  • reconnaît que l’accès à la formation est fourni immédiatement après paiement
  • accepte expressément que l’exécution du service commence avant la fin du délai de rétractation
  • renonce expressément à son droit de rétractation

6. Remboursement

Aucun remboursement ne sera effectué, sauf obligation légale.

7. Utilisation du service

Le client s’engage à ne pas :

  • partager ses identifiants
  • reproduire ou diffuser les contenus
  • revendre ou distribuer la formation

Toute violation pourra entraîner la suspension ou suppression du compte sans remboursement.

8. Propriété intellectuelle

L’ensemble des contenus de la formation (vidéos, supports, documents, etc.) est protégé par le droit de la propriété intellectuelle.
Toute utilisation non autorisée est interdite.

9. Responsabilité

Le vendeur ne saurait être tenu responsable :

  • des interruptions techniques
  • d’une mauvaise utilisation du service par le client

10. Droit applicable

Les présentes CGV sont soumises au droit français.
Tout litige relève des juridictions compétentes françaises.

 

 

 

TERMS & CONDITIONS OF SALE (EN)

1. Purpose

These Terms and Conditions govern the sale of online training provided by Thomas Vincent.

2. Price

The training is sold at a price of €500 (including VAT).
The price is identical for all customers.

3. Payment

Payment is made online by credit card.
The order is confirmed upon successful payment.

4. Access to Training

Access to the training is granted immediately after payment validation.
A personal account with unique credentials is provided.

Access is strictly personal and non-transferable.

5. Right of Withdrawal and Waiver

5.1 Principle

In accordance with EU consumer law, the customer normally benefits from a 14-day withdrawal period.

5.2 Exception for Digital Content

The right of withdrawal does not apply to digital content supplied without a physical medium if performance has begun before the end of the withdrawal period.

5.3 Express Waiver

By placing an order, the customer:

  • acknowledges that access to the training is provided immediately
  • expressly agrees that the service begins before the withdrawal period ends
  • expressly waives their right of withdrawal

6. Refund Policy

No refunds will be granted except where required by law.

7. Use of Service

The customer agrees not to:

  • share login credentials
  • reproduce or distribute content
  • resell or distribute the training

Any breach may result in account suspension or termination without refund.

8. Intellectual Property

All training content (videos, materials, documents, etc.) is protected by intellectual property laws.
Unauthorized use is strictly prohibited.

9. Liability

The provider shall not be held liable for:

  • technical interruptions
  • improper use of the service

10. Governing Law

These Terms are governed by French law.
Any dispute shall fall under the jurisdiction of French courts.

Applicable Language Clause

In case of discrepancy, the French version shall prevail.
